3.1-Parties :
ELLACAR TOURISM INC. ltd. Şti. it is briefly referred to as ‘ELLACAR TOURISM".
The person whose name, surname is indicated in the reservation and/or the persons he/she represents will be referred to as a ‘Consumer or Customer’.
2-Subject :
This contract has been made between the consumer and ELLACAR Tourism. dec. This agreement is issued for the sale of services made by phone or electronically of the services specified in the qualifications and terms of sale on the ELLACAR Tourism website and covers the rights and acquisitions of the parties.
With this agreement, the parties have agreed on the provision of a transfer service from the addresses or hotels designated by them to the airports and / or vice versa before and after the flight, and the performance of this service by ELLACAR Tourism for a fee in accordance with the following contractual terms.
3-Service and Payment Information
- The contract price is the figure specified in the booking confirmation form.
- Different point requests requested in the special transfer service other than the route(s) specified in the reservation; The amount determined by ELLACAR Tourism for each different point is paid by the passenger in the region, including the price if it is on the route and without waiting, and not on the route.
- ELLACAR Turizm has the right to make changes to the transfer vehicle without any fee changes without notifying the consumer if necessary. If the Customer does not accept this change, he/she has the right to cancel his/her reservation and receive the full amount of the fee he/she has paid. In this case, the customer's right to compensation does not arise.
- The consumer hereby authorizes ELLACAR Turizm to collect service fees with the credit card information entered into the system with this agreement. ELLACAR Tourism system is encrypted with 3D Security and the consumer is responsible for the credit card information entered.
- The time for issuing invoices for the purchased service, etc.U.K. it is 7 days, including the date of purchase, provided that the month is not skipped as required.

7-General Provisions
Passengers are required to wear seat belts for traffic laws and life safety.

In order to use the service subject to this agreement, the consumer must have made a reservation no later than 6 (six) hours before the service time. On religious and national holidays, on New Year's and Tuesday public holidays, the transfer must be booked no later than 48(forty-eight) hours before the transfer time. The reservation can be canceled by the customer no later than 6 hours in advance. In this case, the customer is refunded the fee. If the reservation is cancelled later, the service fee will not be refunded. The route to be followed along the way from the point of departure to the destination during the service; it is determined exclusively by ELLACAR Tourism, taking into account traffic, road condition and other criteria.
The customer is not authorized to change this route in transfer services other than allotment and tour services. In this context, requests that the passenger dec to a different location between the designated routes and wait for a while at this location are unacceptable. ELLACAR Tourism is only responsible for transporting the customer from one point to a designated point, point to airport or from airport to a specific point. ELLACAR Turizm is obliged to allocate vehicles in accordance with the number of passengers and baggage volume determined during the consumer's online purchase. ELLACAR Turizm will not be liable for any traffic accident or other other reason that may occur during the Service, if the customer has suffered physical or material damage or if the transported goods have been damaged, for these damages ELLACAR Turizm will not be responsible.
If the customer is in such a situation, ELLACAR Tourism is subject to Article 66 of the code of obligations. It accepts and declares in advance as an informal recourse that it will not have any responsibility arising from its article and other provisions of the legislation. Iş reserves the clauses of this agreement that impose liability on ELLACAR Tourism. Despite the allocation of the appropriate vehicle to the transfer service, if the number of people and the amount of luggage determined by the customer at the time of purchase are exceeded, the transfer is carried out without exceeding the legally established transport limits of the vehicle. Passengers or baggage exceeding the legal limits are not accepted into the vehicle.If the customer refuses the transfer service for this reason, the fee will not be refunded. The customer is obliged to certify to the ELLACAR Tourism personnel in the vehicle at the transfer point that it is the customer who has purchased the service, with identity documents issued by legal authorities or with a booking document. The transfer of the customer who does not fulfill this obligation will not be made.
In case of a situation or operational cancellation and/or other delay caused by a change in flight schedules or if the customer has previously booked a transportation service for the customer, the customer can contact ELLACAR Turizm by phone or ELLACARTRANSFER@GMAİL.COM he is obliged to inform by sending an e-mail to his address. In case of a delay or rotation that will occur for more than 3 hours, ELLACAR Tourism has the right to change the terms of service without notifying the customer. In this context, if there is a cancellation of the flight for any reason, the cancellation of the customer ELLACAR Turizm ELLACARTRANASFER@GMAİL.COM in case of notification by e-mail to his address, if he has not paid the transfer fee, a refund will be made no later than 7 days by the customer's payment method without interruption.
It is the customer's responsibility to load the luggage into the vehicles fully and completely and to pick it up from the vehicle. ELLACAR Turizm is not responsible for the loss and damage of innocent items forgotten by the customer in the vehicle during the transfer. However, if the forgotten item is noticed later by the ELLACAR Tourism staff, it is delivered to the address specified within the borders of Antalya province for an extra service fee within the same day at the request of the customer.
ELLACAR Turizm is not responsible for carrying sacks, chests and similar items that are in a condition to damage the vehicle as baggage during the service. Each passenger has a baggage allowance of 20 kg per person. In case of any baggage loss or damage caused by ELLACAR Tourism, the cost of service is paid to the passenger as material and non-pecuniary compensation for items that have not been declared a value received earlier than the passenger. If the presence of the above-mentioned substances is noticed in the baggage, the situation will be immediately notified by ELLACAR Turizm to the authorized authorities. If the presence of the considered substances is not noticed by the driver and is detected by stopping and searching law enforcement agencies during the transfer, any damage and loss that ELLACAR Tourism will suffer for this reason will be immediately covered by the customer in cash and repeatedly.
The customer's pet transfer requests and the type of pet to be transported will be notified by the customer during the online purchase of the service. No animal transfer is made without the notification in question. You can't transfer animals alone without an adult customer with you. The animal that will be transferred under these conditions can only be transported in the section determined by the ELLACAR Tourism personnel in the vehicle in its private cage, with all kinds of responsibilities belonging to the customer. T.C. the transfer of animals, the acquisition, possession, transfer of which is unlawful according to its laws, is not possible under any circumstances. For transfers from a certain point to the airport; ELLACAR declares and undertakes that the vehicle allocated for tourism will be located at the designated point at the transfer time. A delay of 15 (fifteen) minutes from the time of transfer will be considered a reasonable delay. in case of delay exceeding 15 (fifteen) minutes, the customer does not have to wait for the vehicle. In this case, the transfer fee is refunded to the customer. The site is located at transfer points such as public housing; ELLACAR Turizm is not responsible if the delay time of 15 (fifteen) minutes is exceeded due to the fact that the site security guards prevent the vehicle from entering the site. if 15 (fifteen) minutes are exceeded in this way and the customer is not waiting for the vehicle, the price will not be refunded.The customer must be present with their luggage at the designated point during the transfer time. If the customer is not present at the transfer point during the transfer time, the vehicle allocated by ELLACAR Tourism is obliged to wait for the customer for 15(fifteen) minutes. if the customer does not reach the designated point with their luggage at the end of 15 (fifteen) minutes, the vehicle has no obligation to wait any longer.
At the transfer point, ELLACAR Tourism personnel are not required to leave the vehicle and carry luggage, pet cage, escort the passenger to be transferred until the vehicle is not required.
The transfer of children under the age of twelve will not be carried out without adult escorts with them. The transfer of the companion back to the point of its receipt depends on the purchase of the return service on the website. If a wheelchair transfer is requested together with the customer to be transferred, this issue will be notified by the customer during the online purchase of the service. If the customer specifies the service when purchasing online, one baby seat will be placed in the vehicle to be allocated by ELLACAR Turizm.
In the event that the service subject to this agreement is disrupted, unable to be performed due to weather and road conditions, vehicle malfunction, sudden health problem related to the customer or driver, checks by law enforcement agencies during the transfer and other reasons, and for these reasons the passenger cannot catch the flight; ELLACAR Tourism is only obliged to refund the service price paid in advance to the customer. The provisions of this agreement that stipulate situations in which no refund will be made are reserved. The Customer accepts, undertakes and declares that there is no obligation to reimburse the cost of the ELLACAR Turizm air ticket and other material /moral damage, except for the obligation to refund the cost. In case the customer refuses the transfer during the transfer;
ELLACAR Turizm has no obligation to transfer the customer back to the received point. If the work schedule of the vehicle does not allow, the customer is left in the nearest residential area in accordance with traffic rules. In such a case, the price will not be refunded. ELLACAR Turizm has no such obligation if the customer forgets the item during the transfer and returns it to the point where it was taken for any other reason and requests that the transfer be completed. It is up to ELLACAR Tourism's preference to fulfill this request of the customer to the extent possible by the vehicle's business program. In such a case, ELLACAR Turizm is not responsible for the customer's inability to catch the flight and other damage, and no refund will be made.In case of any health problems of passengers or animals transported in the vehicle during the transfer; ELLACAR Tourism personnel are obliged to transfer the passenger to the nearest health unit immediately. The passenger's request to the contrary does not bind the ELLACAR Tourism staff. The nearest medical unit may be official medical institutions, as well as private medical institutions. ELLACAR Turizm is not responsible for any death, bodily damage, material or other damage caused during and after the transfer of a passenger /animal experiencing health problems to the nearest medical unit. At the end of the transfer, the customer is obliged to sign the notification document stating that he has purchased the service and reached his destination. If requested by the customer, the invoice for the service provided will be sent by ELLACAR Turizm to the address specified by the customer.
8-Force Majeure
The parties themselves of every kind and nature which does not originate from force majeure, natural events, adverse climatic conditions, social events, popular movements that occurred due to the negative developments in working life events, movements of the employee or the employer any legal or illegal, strikes, lockouts, acts of the trade union movement and business slowdown, war, armed conflict, revolution, state of emergency or martial law, intergroup conflict and unrest as a result of the failure to fulfill any obligations subject to this agreement; this agreement will be suspended until the termination of the listed situations /negative effects. The contract will enter into force again after the termination of the listed situations /negative effects. Failure of the parties to fulfill their obligations as a result of force majeure does not entitle the other party to termination or compensation.
9-Cancellation Terms and Other Provisions
Cancellations, changes and refunds cannot be made for any reason on the promotional product purchased by the passenger. Applications to the bank or ELLACAR Turizm for reservations that have passed the date and time, cancellation and refund requests are invalid.
10-Authorization
In case of any objections arising from the application of this agreement, the Laws of the Republic of Turkey will be applied and the Courts and Enforcement Agencies of Antalya will be authorized.
11-Effective Date
3. The passenger(s) who are not signed in the contract but have received the service subject to the contract are assigned to register on their behalf.by reading and signing this agreement, persons are deemed to have accepted the provisions of the contract. This agreement has been prepared in 2 copies and signed by the parties, and in disputes arising from the agreement, the articles of the Road Transport Law No. 4925 and other Turkish legislation apply. Antalya courts and enforcement agencies are authorized.
